PRAHRAN POLICE COURT - ALL ABOUT A DOGThursday, March 21. Before His Worship the Mayor and Messrs. Lane and Clough, J.P.William Walter Bowie was charged with having a dog alleged to be stolen in his possession, the property of William Jones, seedsman, of Prahran. Mr. Seton Williams appeared for the owner and Mr. Kelly for the defence. William Jones deposed to having had a pug dog and slut in his possession some two years since. When going away in June '95, he left the two dogs in charge of a Mr. Lancashire, Wright's Terrace. He advertised in all the papers and reported the matter to the police, offering a reward of £10. He had since seen the dog in the possession of defendant. Was positive the dog was his and would swear to it in the dark amidst a hundred. Witness described the marks by which he recognised the dog. Alfred John Lancashire recognised the dog produced as one that was stolen from him on June 2nd. 1895. Would swear it was the dog left in his care by Mr. Jones. He would pick it out of a thousand. Had not the least doubt as to the identity of the animal produced in court. George Frederick Webb, dentist, of Chapel-street, Prahran, deposed to having bred pugs for the last fifteen years. To the best of his belief the dog produced was the one he had sold to Mr. Jones. Had no doubt as to the dog having been bred by him; to the best of his belief it was the one possessed by Mr. Jones. Had not seen it for two years. It was nothing unusual for a dog to be undershot.To Mr. Kelly : To the best of my belief the dog in court is the one gave to Mr. Jones. Would not swear absolutely.John Sevier, fitter, knew the dog owned by Mr. Jones. Had had charge of the dog at two shows. To the best of his belief that was the dog in court. Would not swear absolutely.Arthur Jones know the dog lost by his brother. Was sure the one in court was the same. Had no doubt. Could pick it out of a hundred others and swear to it.Esther Denman had seen the dog whose ownership was disputed. Identified the one produced as the property of Mr. Jones, but it had been starved and was a disgrace to the people that had him. He had altered a lot.For the defence. Mr. Kelly submitted that there was no evidence to support the contention that the dog was stolen. There was no doubt that it had been lost, but there was none as to it having been stolen There was no evidence that the accused knew the dog in his possession had been stolen, and there was none to support that it was "unlaw-fully" in his possession.The Bench overruled the objections and said they wanted to hear how accused came by it.Mr. Kelly said the defence was the accused saw a man named Tinnim going to drown it at the St. Kilda pier owing to it being mangy. That man had made accused a present of it. Accused gave evidence on his own behalf. He remembered obtaining possession of the dog. It was given to him on the St. Kilda pier by a Mr. Tinnim. He said that it belonged to a lady who had children and who was afraid of it affecting them. The dog at the time had not a hair hardly on him. Mr. Tinnim was going to drown it. Thomas Tinnim, a butcher residing at Down-street, Collingwood, remembered giving accused a dog about twelve months previous at St. Kilda. It was a pug dog. He had the mange. It was the property of his mother, and as it was becoming a nuisance, she asked him to get it drowned. Witness asked his mother not to have it drowned as he knew a man in St. Kilda who would take care of it and cure it.To Mr. Williams : Believed his mother had it for about four years. Mrs. Ann Tinnim deposed to having a pug dog which she had given to her son to take down to accused. She had had the dog in her possession for three years previous to giving it to her son.Cross examined: Received the dog as a present from a lady friend.
