THEFT OF A BICYCLE – A MENTALLY DEFECTIVE CHARGED

At the Sale Police Court on Tuesday last, Lionel Herbert Harwood was charged with stealing a bicycle valued at £6, the property of Leslie Buckley.

Leslie Robert Buckley, labourer at Sale, in evidence said – “About 9 p.m. on 14th December, I left my bicycle outside the Prince Regent Theatre sweet shop and went to a dance. At 12 o'clock I returned and found the bicycle was missing. It cost me £10. I gave the accused no authority to take the bicycle. I value the bicycle now at £6. I identify the bicycle in court as my property.”

Constable Smith, stationed at North Melbourne, said – “About 6.15 a.m. on December 15, in consequence of a telephone message received at the North Melbourne police station, I went to the Presbyterian Boys' Home at North Melbourne. I saw the accused there. I asked him how he got there. He said, "I ran away from the Boys' Home at Sale on Saturday night." I said, "Did you walk down?" He said, "I rode a bicycle." I asked him where he got the bicycle. He said, "I stole it from outside the Prince Regent Theatre at, Sale." I asked where the bicycle was now. He said, "It's outside against the wall." I found the bicycle lying against the wall. I said, "Why did you steal it?" He said, "I wanted to come to Melbourne to look for work." He was then brought to the North Melbourne police station and charged.”

Dr. 'Fitzpatrick, legally qualified medical practitioner, in evidence said – “I attended to the defendant about December 1933, for epileptic fits, following a depressed fracture of the skull, sustained about three years previous. An operation was performed, and the fits disappeared. For the last six months his mental condition has been abnormal. I consider him mentally defective by reason of injuries sustained to his head. Mr. Elson Smith, Superintendent of the Kilmany Boys' Home, in evidence said defendant had been under the care of the Presbyterian Church since he was four years old. Up till six months ago he responded to the treatment he received at the Home. Then he became violent. The Home was not properly staffed to deal with such cases. He had been given special attention and witness thought he should be placed in some Government institution. The Home authorities were very sorry but thought it would be for defendant's good.

In reply to the P.M., Sergeant Olive said he did not know of any suitable institution to which defendant could be committed.

Mr. Smith: Royal Park said: He is over age!  I understand they receive such cases at the Royal Park depot till they can place them in a suitable home.

The P.M.: What about returning him to the Kilmany Boys' Home till he can be placed somewhere? Mr. Smith: In his present mental state we feel the responsibility would be too great.

Defendant, who pleaded guilty to the offence, was remanded for eight days. In the meantime, efforts will be made to have defendant placed in a suitable institution.
