1887 – Sale of Launder Paddock
The facts of this episode in the Launder story can be found in both web pages for George Launder and Sarah Gardiner and also Mary Ann Launder.

In summary, John Collings became trustee of the finances of Sarah Launder, nee Gardiner, and her children, and therefore the sale of the Launder Paddock in 1876.  The youngest Launder child, Mary Ann Launder, took court action against John Collings in 1877 alleging misconduct in his handling of the proceeds of the sales.

The court proceeds were lengthy and took ten years for the judgement to be handed down.  It was reported in The Argus newspaper on September 23 1887 –

Mr Justice Webb gave judgment in the Supreme Court yesterday in an action of Launder v Collings the plaintiff, Mary Ann Launder, sued the defendant, John Collings, for accounts relating to the sale of certain land at Hawthorn. The plaintiff was the daughter of a Mr George Launder, who died in 1865. The defendant married another daughter of the deceased.

By a sort of family agreement, the land left by George Launder was transferred to the defendant in trust for sale and distribution of the proceeds from time to time among those entitled to them. Some of the land had been sold, and the proceeds divided, and releases executed in favour of the defendant, but the plaintiff ultimately objected to the accounts and claimed to have them audited.

She also objected that the defendant had purchased some of the land for himself, and that as trustee he had no power to buy the land for himself. The defendant contended that the plaintiff was entitled only to the accounts from the date of the last release signed by her, and he claimed that all the family had consented to his buying the allotment the purchase of which the plaintiff now objected to.

His Honour was of opinion that the plaintiff was entitled to have all the accounts relating to the property taken and that the defendant was liable to the plaintiff for her share of the difference between the price he paid for the allotment bought by him and its present value, and he made a decree for accounts on that basis, the defendant being allowed 6 per cent interest on the payments made by him in respect.

John Collings seems to have been involved in many of the Launder financial arrangements - in 1883, Jane Launder, wife of George Launder, carpenter of Bairnsdale, who was Eleanor Ann Launder’s brother, bought 40 acres of land on the Mitchell River.  The land at one stage was mortgaged to John Collings (from 1883 to 1886).  Jane died on July 8, 1898.  Probate was granted to Percy John Russell.

Also, Eleanor’s brother, George Launder, Clerk of Works, owned property in Gardiner (adjacent to Glen Iris) in 1886, and apparently fell upon bad times, being sold up by the sheriff in 1890.  The property was mortgaged to John Collings, husband of Eleanor Launder.
